Terms of Service
SpeedPhoneDating.com (and its associated Facebook application) will be referred to in this service agreement as SPD. The SPD service that keeps member phone numbers private will be referred to as the PhoneDialer.
SPD is a service intended to assist with and facilitate the availability of speed dating over the phone. In order to use the PhoneDialer, you must have access to a landline, cell, or VoIP phone.
1. You indicate acceptance of these terms by your continued use of the service, after being notified about them.
2. SPD may discontinue or suspend any of its services at any time.
3. SPD can place limitations at its discretion on the use of its service.
4. SPD can change this agreement at any time, by placing a notice on our website. Continued use of SPD's services indicates acceptance of the new terms of service.
5. You certify that you are 18 years of age or older. You indemnify the publisher, the service provider and the telecommunications companies from any losses, liability, costs and/or expenses incurred by them and any legal action commenced against them or any of them as a result of the viewing or the retrieving of materials or use of the services. You acknowledge all responsibility for using the services provided by SPD.
6. We'll do our best to be up 24 hours a day and 7 days a week but are not responsible in the event of an outage. We aren't responsible if your internet access provider isn't working.
7. As a member of SPD, it is likely you'll be contributing your own content. You may not contribute any sexually explicit adult materials. Content you contribute may not infringe on property rights of others. The content you contribute must not be malicious or cause actual damage (i.e. a virus). If SPD warns you to remove content from public view, or make it private ourselves, you may not leave it up or put it back into public display. The content you contribute must not be hateful or generally intended to offend most people who view it.
8. SPD reserves the right to refuse service to anyone for any reason. Some reasons that may get you banned: obscene content contributions, being a nuisance to the SPD community, or spamming.
9. In case your account is suspended for reasons of delinquency (obscene content, being a nuisance, spamming, etc), SPD is not required to provide a refund of any incurred fees. We are not liable for any losses.
10. You are solely responsible for anything uploaded under your account, even if it wasn’t you. Guard your Facebook access credentials.
11. Do not spam users. Don’t harass users. Don’t impersonate anyone’s identity (username or real). Don’t post false information. Don’t delete or edit others' materials in a way that ruins the original.
12. SPD is not responsible in the event of an outage or discontinuing of access to the PhoneDialer service.
13. Access to the PhoneDialer is limited by geographic location. We are not liable if you can not use the PhoneDialer for any reason including your choice of phone service provider. Currently, the PhoneDialer is available to users in Canada and the United States only.
14 Each user may register for a specific seminar only once. We will attempt to match you up with one (and only one) date for that seminar. This matching will be done on a first come first served basis taking into account the dating requirements specified by the user at registration (age range, gender, etc). We provide no gaurantee that we can match you with a date for every or any registered seminar.
15. As a new member you will receive one seminar credit that allows you to register for a speed phone dating seminar. Should you run out of seminar credits, you will be presented with options to purchase more seminar credits or earn seminar credits through other means, such as filling out a survey.
16. Seminar credits never expire when not used, but can only be used for one speed phone dating seminar.
17. You will receive a refund of your seminar credit in the following cases: SPD was not able to match you with a date for a seminar or if a requested phone date is denied by the receiver. If there is an error dialing a members number for the date, you will be given the option to reschedule the phone date for a future date and time.
18. If an upcoming phone date's scheduled time is surpassed: The phone call will be dialed from our number. The first person called will be asked to press 1 and then #, after which the person will be connected with the other party of the date.
19. You are responsible for any charges incurred by your phone service provider while using SPD and PhoneDialer. Be aware of your phone service agreement and charges that you may incur as a result of using SPD.
20. The PhoneDialer obfuscates a member's caller id while also hiding the number of the member being connected. SPD is not responsible for any event that may occur that results in a phone number becoming known unintentionally such as application bugs.
21. Any content that you contribute to the community may be viewable to the public, except for your phone number.
22. Your account is associated with a phone number, given to SPD at registration. This is the phone number that will be dialed by the PhoneDialer. Changing this number is, in general, not allowed. You may request a new phone number to be associated with your account by sending an email to website administrators, reachable via the 'contact us' link in the case that your number actually changes. We reserve the right to not allow a number change for any reason.
23. SPD is not liable for anything you find on the site. That being said, we’ll do our best to remove bad users and content.
24. SPD is not liable for any loss of data.
25. SPD may have some application bugs. Let us know, and we'll get to work on fixing them.
26. We are not responsible for harm to your computer or phone that comes as a result of using SPD, directly or indirectly.
27. We aren’t responsible for any content posted on a third party site that links to or mentions SPD.
28. You agree to hold SPD and its personnel blameless in any lawsuit.
29. While using SPD, you will be given the option to receive email messages from SPD via the email address you have associated with your Facebook account. If you opt to receive email messages from SPD, you will only receive email messages for the following reasons: a phone date is about to occur, someone has sent you a message or a reply to a message. Notifications will also be sent to your Facebook page while allowed for the same reasons.
30. We reserve the right to change the cost of seminar credits or methods of acquisition at any time. All charges made before price changes will still be honored at the terms for which the acquisition was conducted.
31. If your credit card is declined, your payment does not go through, or fees received from advertisers (as a direct result of actions on your behalf) are charged back, we reserve the right to deduct seminar credits acquired through such action.
32. If you no longer authorize the application in the Facebook network, we reserve the right to no longer store any of the data you have contributed to SPD. That being said, we will do our best to maintain as much data as possible in hopes you will renew our service.
33. Any data or content you contribute to SPD becomes SPD's property. You do have ownership of your account.
34. You are allowed to circumvent use of the PhoneDialer by exchanging numbers with other users directly or taking your social interaction onto the Facebook platform.
35. We are not responsible for the anonymity of your use with SPD. That being said, we regard your privacy (especially your phone number) with the utmost importance and will be on the watch for improved procedures, methodologies, and technologies for protecting private information.
36. You are not allowed to transfer your account to another person for any reason.
37. This agreement overrides any previous Terms of Service agreements you had regarding SPD.
38. Use of SPD's services require a Facebook account.
